Mr. Jentes has served during the last half dozen years as a mediator and as sole arbitrator, chairperson, and a member of 3-person arbitration panels in a wide range of disputes for the American Arbitration Association, the International Centre for Dispute Resolution, the CPR International Institute for Conflict Prevention & Resolutio, the International Chamber of Commerce and JAMS, as well as in non-administered matters. The disputes have involved U.S. and international patent, copyright and trademark claims, post-acquisition accounting and tax adjustments, insurance and re insurance coverage, alleged contract breach, securities fraud, product liability and construction defects, real estate transactions, franchise and distribution rights, and a variety of other commercial, competition and tort issues. The parties have encompassed Bermudan, Canadian, Danish, Dutch, English, French, German, Japanese, Norwegian, Russian, Swiss, Venezuelan and U.S. companies. For close to forty years, Mr. Jentes was a principal litigating partner at Kirkland & Ellis, LLP, serving as lead trial and appellate counsel in many of the firm
• In the international arena, representative recent awards have resolved disputed control of Ukraine’s largest telecommunications company, alleged defects in Austrian tooling for a plastics fabricating plant, indemnification for an adverse judgment relating to biogenetic patents, compensation for marketing a Nigerian cell phone system, a supply contract for surgical devices, and several coverage disputes under Bermudan professional liability and professional responsibility policies.
• Domestically, recent arbitrations have included contested radiologists’ fees at diagnostic centers, contract claims relating to an auto dealer computer system, allocation of environmental remediation costs, a coverage dispute over legal malpractice losses, facilities and service claims under the Telecommunications Act, alleged breach of representations in the sale of a consumer products business, cleaning and hand tool franchising challenges, and misappropriation of banking clients.
• Several arbitrations posed difficult class issues, including the clause construction award by one of the panels on which I serve that is now before the Supreme Court in the Stolt-Nielsen appeal.
Mr. Jentes regularly participates in ADR educational programs as speaker and panelist, conducting, as examples the session on “Managing the Parties, the Lawyers, the Panel and the Hearing Process” at the ABA Arbitration Training Institute in Chicago, 5/05, and providing “Five Key Questions for Mediation Counsel – A Mediator’s Perspective”, to the CNA National Conference of Lawyers and Defense Counsel in Atlanta, 10/08. Mr. Jentes is also a frequent attendee at ADR conferences, most recently the ICC, ICDR, IBA and LCIA conferences in connection with the celebration of the 50th anniversary of the New York Convention in New York, 1/08 and 2/08. Among the other conferences, symposia and training sessions he attended in recent years were LCIA’s European Users’ Council Symposium at Tylney, England, 5/06, the AAA Neutrals Conference in Miami, 3/06, the CPR Annual Meeting in New York, 1/06; the Conference of the International Federation of Commercial Arbitration Institutions in Washington, 6/05, the ICC Conference on International Arbitration in Charlottesville, 6/05, the AAA International Arbitrator Training Workshops in San Francisco, 9/03 and New York, 10/00; the AAA Commercial Arbitrator Training Workshops in Chicago, 10/02 and Boston, 5/02; and the NASD training session in 12/04.
Mr. Jentes is a member of the AAA International Centre for Dispute Resolution and Commercial panels, the Commercial and International Arbitration and Mediation panels of CPR, and the rosters of the ICC International Court of Arbitration, the London Court of International Arbitration, and the Chicago International Dispute Resolution Association.
