Over 45 years of structuring, planning, and resolving disputes for major corporations and governmental entities in areas of: energy, oil and gas, pipeline construction, communications, aircraft (manufacturing/sale/lease/financing), debt collection, restructuring, transportation, real estate development investment, and cross-border mergers/asset acquisitions. Long-term expertise in dispute resolution matters (litigation/arbitration/private resolution) in following jurisdictions: Mexico, South America, Canada, United Kingdom, France, Germany, Japan, Saudi Arabia, Italy, Philippines, and China. Delegate for the U.S. State Department for Negotiation of UNCITRAL Treaty on International Insolvency at the United Nations, New York and Vienna. Practiced at Kansas Geological Survey, reservoir studies, salt domes, secondary recovery and Phillips Petroleum, recovery programs and reserve studies. Legal matters involving oil and gas ownership interests, field participation, drilling contracts, equipment purchases, i.e. rigs, pumps, chemicals, pipeline inspection and drilling programs. Director April 1977 to March 2005, and Advisory Director March 2005 to November 2013 of publicly listed oil and gas production company. Represented various parties in negotiations and documents for aircraft purchases, financing and leasing by airlines, dealers, private parties; major outside counsel for Mitsubishi Aircraft in construction of turbo and jet aircraft, including corporate, manufacturing and assembly, sales, leasing agreement, F&A (registration, certification issues) and product liability. Extensive experience representing clients in international arbitrations, and more than ten years of experience serving as a neutral arbitrator in international and domestic commercial arbitrations. Examples of such work as counsel include representation of parties in an ICC international arbitration relating to Colombia pipeline contracts, and service as Lead U.S. counsel in an international arbitration between a Mexican TV station and a U.S. national TV network. Experience as a neutral arbitrator includes service as a sole arbitrator in oil and gas, international sales and distribution contract, and shareholder/security interest disputes; neutral panelist arbitrator in a multimillion dollar international dispute between a Canadian company and an Australian company over disputes arising under an Independent Sales Representative agreement; a multimillion dollar domestic AAA arbitration between an aircraft manufacturer and its supplier of wing assemblies and arbitration of large corporate jet sale; panel chair in a complex AAA/ICDR international arbitration relating to development and investment contracts involving a commercial real estate project in Las Vegas, Nevada involving over a billion dollars; sole arbitrator of multimillion failed financing by Middle Eastern lenders; sole arbiter of contract disputes, breaches and rights between two Fortune 500 companies involving wholesale, retail sale, distribution and service agreement ; panel arbitrator of disputes of Korean manufacturer of medical equipment with distributor, termination and contract rights; disputes under Section 1031 real estate tax exchange and breach of contract and contractual issues.
